To execute the “Detailed Project for Altering Kaohsiung City Urban Plan (Nanzi Technology Industrial Park and Areas near Houjing and Youchang) - Relevant Regulations regarding Business and Financial Plan for Type B Industrial Zone (Industrial Zone No. 7) and Land Use Control Measures and Zoning” (the “Project”), the Guidelines are hereby formulated.
1.The Guidelines shall apply to those who apply for development in building bases in the Nanzi Technology Industrial Park.
2.Those who apply for development in a building base with a floor area ratio not exceeding 300% shall apply for the building Zlicense with the Bureau of Industrial Parks, MOEA (the “Bureau”) according to the current building management procedures.
3.Those who apply for development in a building base with a floor area ratio ranging from 300% to 400% shall be subject to requirements under Clause 6 to Clause 8.
4.For those who apply for development in a building base with a floor area ratio exceeding 400% that comply with circumstances stated in Appendix 1 of the Guidelines, the buildings’ floor area ratio may be increased; however, the floor area ratio of the building base (including the sum of the permitted additional floor area ratio) shall not exceed 490% at most.
5.When applying for building on the building base according to the Guidelines, the reserved spaces shall have afforestation, and the afforestation area shall not be lower than 20% of the base area.
When the afforestation area is lower than 20% of the base area due to the conditional restrictions of the base, rooftop afforestation, rooftop solar power generation equipment, or external wall afforestation may be used in substitution; however, the substituting rooftop afforestation, rooftop solar power generation equipment, or external wall afforestation may not be included in the calculation for the additional floor area ratio.
When applying for the building usage alteration license according to the Guidelines, and when the afforestation area is lower than 20% of the base area due to the conditional restrictions of the base, the green building label obtained for the building may be used in substitution.
6.When the building base of a business in the Park is applied for building according to the Guidelines, it shall enclose six copies for each of the drawings and documents stated in Appendix 2 of the Guidelines to apply for the additional floor area ratio.
For the application in the preceding paragraph with the approval of additional floor area ratio from the Bureau, application for building license or the usage alteration license shall be made to the Bureau within six months from receiving the approval. However, when the application is not made within the period, an extension of three months may be made, and the extension may only be made once; the effect shall become invalid when overdue.
7.The additional floor area ratio application for the building base shall be reviewed by the Bureau and reported to the Kaohsiung City Government for approval; after paying the monetary substitution to the Bureau or Kaohsiung City Government according to the exaction regulations, the building license or the usage alteration license may be applied.
The exaction procedures and the calculation method for the payment of monetary substitution in the preceding paragraph shall be subject to the regulations related to the additional floor area calculation method and the changing calculation method of the additional floor area ratio for the project.
8.The cap for the total additional floor area of the entire area in aggregate is 690,000 m2 in total; when the total additional floor area is fully used, the Guidelines shall cease to be applicable.
The usage for the total additional floor area of the entire area shall be regularly announced by the Bureau for public knowledge.
